Terms of Service

Terms of Service for 1on1electrical.com – Virtual Electrical Consultation

This Terms of Service (“Agreement”) governs the virtual electrical consultation services provided by 1on1electrical.com (“1on1 Electrical”) to the Customer. By scheduling a virtual support call and paying the upfront fees, the Customer agrees to be bound by the following terms and conditions:

Scope of Services: 1on1 Electrical offers virtual, visual reviews and recommendations on common electrical problems around the house in a safe manner through one-on-one Zoom calls. The consultation is limited to conditions readily accessible and installed systems and components of the property. 1on1 Electrical is not an inspector, insurer, or guarantor against any defects in the structure, items, components, or systems reviewed during the virtual call. Latent and concealed defects and deficiencies are excluded from the scope of services.

No Warranties: 1on1 Electrical makes no warranty, express or implied, as to the fitness for use, condition, performance, or adequacy of any existing structure, item, component, or system discussed during the virtual call.

Liability Limitation: The services provided by 1on1 Electrical are performed solely for the benefit of the Customer and no other person or entity. 1on1 Electrical will not be liable to the Customer or any other party for any damages, whether actual, direct, incidental, or consequential, arising from:

The use, loss of use, or performance of Customer’s structure, items, components, or systems caused by accident, misuse, disaster, abuse, neglect, alterations, or by repairs or parts not provided by 1on1
Electrical.

Failure of Customer to maintain the structure, items, components, or systems.

Use by the Customer other than as intended.

Any damage resulting from any accident, neglect, alterations, improper use or misuse by non-1on1 Electrical personnel, or any other causes beyond the control of 1on1 Electrical.

Indemnification: In the event that any person, not a party to this Agreement, makes any claim against 1on1 Electrical, its employees, or agents, arising out of the services performed by 1on1 Electrical, the Customer agrees to indemnify, defend, and hold harmless 1on1 Electrical from any and all damages, expenses, costs, and attorney fees arising from such a claim.

Limitation of Liability: The liability of 1on1 Electrical, its officers, agents, or employees for errors, omissions, breach of contract, negligence, fraud, misrepresentation, or any other claim related to this Agreement is limited and fixed to a refund of the fee paid to 1on1 Electrical for the virtual call.

Time Limit for Claims: Any legal action or proceeding of any kind against 1on1 Electrical, including those sounding in tort or contract, must be brought within one (1) year of the date of the virtual call or will be deemed waived and forever barred.

Attorney’s Fees: In any dispute, the prevailing party shall be entitled to recover its attorneys’ fees, expert fees, and costs from the non-prevailing party.

Severability: If any provision of this Agreement is deemed unenforceable by a court or arbitrator, the intention of the parties is that such provision shall be enforced to the extent that the court or arbitrator determines to be reasonable, and the unenforceability of such provision shall not render the remaining provisions unenforceable.

No Guarantee of Results: The recommendations and advice provided during the virtual consultation are
based on the information available at the time of the call and may not guarantee the resolution of any specific electrical issues.

Personal Use Only: The virtual consultation services provided by 1on1 Electrical are for the Customer’s personal use only and shall not be used for commercial purposes or shared with third parties without explicit consent.

Confidentiality: Both parties agree to treat all information exchanged during the virtual consultation as confidential and not disclose it to any third party without prior written consent, except as required by law.

Jurisdiction and Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

By scheduling a virtual support call and paying the upfront fees, the Customer acknowledges that they have read, understood, and agree to be bound by this Terms of Service Agreement with 1on1electrical.com.
